1. How Kensa Uses AI
Kensa is an AI video generation platform that uses third-party artificial intelligence models to create video content from text prompts and images. The AI models we use include, but are not limited to, Sora 2 (OpenAI), Veo 3.1 (Google), and Seedance 1.5 Pro (BytePlus).
All videos generated through our platform are created by AI algorithms, not by human creators. We believe in full transparency about the nature of our content generation process.
2. AI-Generated Content Labeling
In compliance with the EU AI Act (Article 50) and our commitment to content authenticity, all videos generated through Kensa are labeled as AI-generated content:
- Visual watermark: Videos include a "Kensa AI Generated" watermark by default.
- Metadata embedding: Video files contain embedded metadata identifying them as AI-generated, including the model used and generation timestamp.
3. Copyright & Intellectual Property
Important: The copyright status of AI-generated content is evolving and varies by jurisdiction. Key points you should understand:
- The U.S. Copyright Office has indicated that purely AI-generated visual or video outputs may lack sufficient "human authorship" to qualify for copyright registration and protection.
- The EU AI Act requires transparency about AI-generated content and respects content owners' machine-readable opt-out signals.
- You are granted a license to use the videos you generate through Kensa for commercial purposes (subject to your subscription plan), but this license does not constitute a transfer of copyright ownership.
We strongly recommend consulting with a legal professional before using AI-generated videos in contexts where copyright ownership is critical (e.g., trademark applications, advertising claims, or branded content).
4. Content Responsibility
While Kensa implements content moderation to filter harmful prompts, you are ultimately responsible for:
- Ensuring your prompts and input images do not infringe on third-party rights
- Not using generated content to create misleading deepfakes or impersonate real individuals without consent
- Complying with applicable laws regarding AI-generated content in your jurisdiction
- Disclosing the AI-generated nature of content where required by law or platform policies
5. Data & Privacy
Your prompts and uploaded images are processed by third-party AI model providers to generate videos. Please review our Privacy Policy for details on how your data is handled. We maintain generation logs for compliance and abuse prevention purposes.
6. DMCA & Takedown Requests
If you believe that content generated through Kensa infringes on your intellectual property rights, please contact us at [email protected] with the following information:
- A description of the copyrighted work you claim has been infringed
- The URL or identification of the infringing content on our platform
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate
We will process valid DMCA takedown requests within 48 hours.
7. EU AI Act Compliance
Kensa is committed to compliance with the European Union Artificial Intelligence Act (EU AI Act), which has a general application date of August 2, 2026. Our compliance measures include:
- Transparent labeling of AI-generated content (visual and metadata)
- Content moderation to prevent generation of prohibited content
- Maintaining generation logs for traceability and accountability
- Regular review of our practices against evolving regulatory requirements
